Terms of Service

1. Acceptance of Terms

By downloading, installing, or using MoBazar, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the application.

2. Eligibility

• MoBazar is open to users of all ages
• You may use MoBazar from any location, though the marketplace primarily serves Mauritius
• You must provide accurate information when creating an account

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

4. Use of the Platform

MoBazar provides a marketplace for buyers and sellers in Mauritius. You agree to use the platform only for lawful purposes. You must not:

• Post false, misleading, or fraudulent listings
• List prohibited, illegal, or counterfeit items
• Harass, threaten, or abuse other users
• Attempt to manipulate prices or reviews
• Use automated tools to scrape or collect data from the platform

5. Seller Obligations

If you register as a seller on MoBazar, you agree to:

• Provide accurate descriptions and images of listed items
• Set fair and honest prices
• Respond to buyer inquiries in a timely manner
• Comply with all applicable Mauritian laws and regulations
• Honour the terms of any agreed-upon transaction

6. Buyer Obligations

As a buyer, you agree to communicate respectfully with sellers, honour agreed-upon transactions, and report any issues or disputes through the appropriate channels. MoBazar is not a party to transactions between buyers and sellers.

7. Transactions & Payments

MoBazar facilitates connections between buyers and sellers but does not process payments directly. All transactions are conducted between the parties involved. MoBazar is not responsible for the quality, safety, or legality of items listed, the accuracy of listings, or the ability of sellers to complete a sale.

8. Content & Intellectual Property

You retain ownership of content you post on MoBazar. However, by posting content, you grant MoBazar a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your content in connection with the platform. You must not post content that infringes on the intellectual property rights of others.

9. Privacy & Data

Your use of MoBazar is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the platform, you consent to the collection and use of your data as described in our Privacy Policy.

10. Prohibited Items

The following items are strictly prohibited from being listed on MoBazar:

• Illegal drugs and controlled substances
• Weapons, firearms, and ammunition
• Counterfeit or stolen goods
• Hazardous materials
• Items that violate Mauritian law

11. Account Suspension & Termination

MoBazar reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms of Service, is harmful to other users, or is otherwise inappropriate. You may also delete your account at any time through the app settings.

12. Disclaimers

MoBazar is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the platform. We do not guarantee that the app will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by Mauritian law, MoBazar and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you have paid to MoBazar, if any, in the twelve months preceding the claim.

14. Refunds and Disputes

MoBazar is a discovery platform only. We connect buyers and sellers but do not participate in, process, or facilitate any transactions.

All purchases and payments occur directly between buyers and sellers, outside of MoBazar. MoBazar does NOT handle money, payments, or refunds.

MoBazar is NOT responsible for: refunds or returns, product quality or authenticity, scams or fraudulent sellers, failed transactions, or disputes between buyers and sellers.

If you are scammed or have a dispute, you must resolve it directly with the other party or through local authorities. We encourage buyers to inspect all products in person before paying. We encourage meeting in safe, public locations.

By using MoBazar, you acknowledge that all transactions are at your own risk.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Mauritius. Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.

16. Changes to Terms

MoBazar reserves the right to modify these Terms of Service at any time. We will notify users of significant changes through the app or via email. Your continued use of the platform after changes are posted constitutes your acceptance of the updated terms.
